Workshop - The Redress of Law

Debating Christodoloudis - Unconventional works merit special attention. The legal philosopher Emilios Christodoloudis (Chair of Jurisprudence at the University of Glasgow) has recently published a book in which he seeks to reclaim the intellectual space of the constitution for law and democratic politics and to push back against the predominance of the market mentality.

The Redress of Law: Globalisation, Constitutionalism and Market Capture (Cambridge University Press,
2021) not only offers an analysis of what is intellectually at s take in the contest between “political” and “market” constitutionalism, but it also reconstructs the turn towards the latter that it has taken in the European Union. The author defends a version of the constitutional project that puts the values of solid arity and human dignity in particular, the dignity of labour at the center. In the face of the uncertain future of neoliberal ideologies the work concludes by hinting at alternative trajectories.

The participants will discuss major themes of the book with the author in the course of a one day workshop. These themes include the normative relevance of social system’s theory to constitutional analysis, the dominance of market constitutionalism in the EU, critical approaches to international
law or the merit s of “societal constitutionalism” as an alternative.
